Commission terms and conditions
These are my Terms of Service for all NONCOMMERCIAL DIGITAL projects only. These commissions are not for use as NFTs or for training/generating AI imagery, under any circumstances. These terms and conditions are subject to revision, addition and editing without notice. Please contact me directly to discuss traditional pieces, digital pieces that are not listed in my pricing guide or commercial projects. To see my price guide or to look at examples of some of my work, please click the relevant links above._______________________________________________________________________________________________________1) The prices displayed on the pricing page of this site are subject to change according to the difficulty, complexity, and size of each individual piece.2) Clear visual references and a description of the commission concept must be provided via a commission request email. After which a preliminary quote will be provided.3) Once finalised, payments must be made in full within seven (7) days of the invoice being issued before any work will be started. Once the full payment has cleared, the commission will be added to the queue list.4) Payments will only be accepted in USD through Paypal. No other forms of payment will be accepted.5) The client will have the chance to make alterations during the sketch stage, and again at the flat colour stage (if required). Major revisions that diverge from the Client's original commission description/references may increase the commission time and may incur extra charges, which will be billed separately.6) Refund policy: If the client wishes to cancel their commission before work begins, the artist will retain 5% of the original commission payment as a convenience fee. In the event of Client cancellation during the sketch phase (on commissions larger than a sketch), a 50% refund of the original payment will be issued. No refund will be issued if the Client cancels beyond the sketch phase.7) The Artist reserves the right to cancel a commission and issue a refund due to poor client communication, rude or inappropriate behaviour, or inability to communicate clearly or effectively. The Artist may also cancel a commission due to an unforeseen inability to complete the commission within an appropriate time frame.8) The artist will not handle the depiction of illegal activities, sexually explicit (x-rated) materials or hateful images. Non-explicit, artistic nudity and mild gore will be considered on a case-by-case basis. The Artist reserves the right to reject any commission for any reason.9) The artist will not handle any commissions that are for the purpose of creating NFTs or for the training/generation of AI art. These commissions are intended to create personal individual pieces, not art or imagery for resale and reuse.10) The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the commissioned work is a time-sensitive gift (such as a birthday gift), a delayed public showcase may be requested by the Client.11) The Artist retains ALL the rights to the commissioned artwork, including the right to make prints, merchandise and to alter the commissioned work to make it more generic for print at the Artist’s discretion. Image rights may be negotiated for an added fee.12) The Client retains all rights to their respective characters. This does not allow them the overall rights to the commissioned image (see point 11).12) The Client may not profit from the artwork. This includes the sale of digital files, selling rights to the image, or the creation and selling of NFTs from the commissioned artwork (see point 9).13) The Client may create up to four (4) prints for personal use (such as for display in their home or as gifts). The client may also resize the artwork to create icons or similar graphics to be used in a non-commercial digital format. The Client must not alter the artwork itself, or remove any watermarks.14) The Client may upload the commissioned artwork to their personal website or gallery as long as it is accompanied by a credit line and a link to the Artist and this site (eg. Image by ArtByJezzaboo, find her at https://artbyjezzaboo.carrd.co/). This uploaded version must not be any high-resolution file or an unwatermarked version of the artwork.15) The Artist might not be available to answer emails on holidays, scheduled days off work, or during emergencies. If you do not receive an email reply within a week (7 days), please resend your email.16) The Client must read, understand, and agree to all the above terms before entering into a commission agreement with the Artist. By sending payment, the Client agrees to the above terms.
